1. Eligibility
The Service is intended for adults such as parents, legal guardians, and authorized caregivers. You must be legally able to enter into these Terms. Children should not independently create or operate ChildArt accounts.
2. Description of Service
ChildArt AI helps adult users document children’s artwork, maintain child profiles, and receive AI-assisted educational observations and, where available, longitudinal insights. Features, limits, and availability may change over time as described in these Terms.
3. AI-Generated Observations
The Service generates AI-assisted educational observations about artwork you upload. AI output may be inaccurate, incomplete, or misleading. Outputs are educational observations only. They are not a diagnosis, not a psychological evaluation, not medical advice, not therapy, not an abuse or neglect determination, not a developmental assessment, and not a substitute for licensed professionals.
A drawing alone cannot establish abuse, trauma, mental illness, developmental disorder, intelligence, family relationships, or a diagnosis.
If you have concerns about a child’s safety, development, mental health, or well-being, seek an appropriate qualified professional.
4. Not Medical or Psychological Advice
ChildArt AI is not a medical or psychological diagnostic service and does not provide clinical care. Nothing in the Service should be treated as professional advice. Always use your own judgment and consult qualified professionals when needed.
5. Child Information / Authorized Adult Representation
By creating a child profile or uploading a child’s artwork, you represent that you are a parent, legal guardian, or other authorized adult entitled to provide that information and content for use with the Service. You are responsible for how you interpret and share results within your household.
6. User Content
You retain ownership of artwork and other content you upload (“User Content”). CHILDART INTELLECT does not claim ownership of a child’s artwork. You grant CHILDART INTELLECT only the limited rights necessary to host, store, transmit, process, and analyze User Content to operate and provide the Service, including transmission to service providers such as OpenAI for requested AI-assisted analysis.
You represent that you have the rights needed to upload User Content and that it does not violate law or third-party rights.
7. Free Plan
Unless we change plan limits prospectively with notice, the Free plan includes:
- 3 lifetime successful analyses;
- 1 child profile.
Deleting an analysis or artwork does not restore Free-plan quota. Failed analyses should not consume Free-plan quota.
8. ChildArt Plus
Unless we change plan limits prospectively with notice, ChildArt Plus includes:
- 30 successful analyses per subscription-anchored month (applies to both monthly and yearly Plus subscribers);
- up to 5 child profiles;
- longitudinal insights after the required analysis threshold described in the app.
Failed analyses should not consume Plus quota. Deleting an analysis or artwork does not restore quota. Restore Purchases does not grant extra quota. Reinstalling the app, signing out, or signing in again does not reset quota.
We do not promise that any particular feature will remain available forever. We may change features or limits prospectively with appropriate notice.
9. Apple Subscriptions
Paid subscriptions are purchased and managed through Apple. Payment is charged to your Apple ID account. Subscriptions renew automatically unless cancelled in accordance with Apple’s rules and timing. Manage or cancel in your Apple ID subscription settings. Apple’s terms also apply to billing and refunds handled by Apple.
10. Restore Purchases
Restore Purchases is intended to re-link an eligible Apple subscription entitlement to your ChildArt account. It does not create a new subscription by itself and does not grant additional analysis quota within the same active quota period.
11. Accounts and Security
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. Notify us promptly of unauthorized use. We may suspend or restrict access to protect the Service or other users.
12. Acceptable Use
You agree not to:
- use the Service for unlawful, harmful, or abusive purposes;
- attempt to obtain clinical diagnoses or misuse educational outputs as professional determinations;
- upload content you are not authorized to share;
- probe, disrupt, or reverse engineer the Service except where such restriction is prohibited by law;
- circumvent usage limits, security controls, or subscription verification.
13. Intellectual Property
The Service, including software, branding, and original materials we create (excluding User Content), is owned by CHILDART INTELLECT or its licensors. These Terms do not transfer ownership of those materials to you.
14. Service Availability
We aim to keep the Service available, but we do not guarantee uninterrupted or error-free operation. Features may be delayed, limited, or unavailable due to maintenance, network issues, provider outages, or changes.
15. Third-Party Services
The Service relies on third parties, including Apple (distribution, payments, and related services), Supabase (authentication, database, storage, and server functions), and OpenAI (AI-assisted analysis via the Chat Completions API). Their terms and privacy practices apply to their services. We are not responsible for third-party services we do not control.
16. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT AI OUTPUTS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.
17. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHILDART INTELLECT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM (EXCLUDING AMOUNTS PAID TO APPLE THAT WE DO NOT RECEIVE) OR (B) CAD $50.
Some jurisdictions do not allow certain limitations. In those cases, the limitation applies only to the fullest extent permitted, and non-waivable consumer rights remain available.
18. Account Termination / Deletion
You may stop using the Service and delete your account in the app. We may suspend or terminate access if you violate these Terms or if we discontinue the Service. Deleting your ChildArt account does not automatically cancel an Apple subscription; cancel through Apple if needed.
19. Changes to Service / Terms
We may update the Service and these Terms from time to time. When we post revised Terms, we will update the effective date. Continued use after changes become effective constitutes acceptance, except where applicable law requires additional notice or consent. Material changes to paid plan limits will be applied prospectively with appropriate notice.
20. Governing Law
These Terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law rules. Courts in Ontario will have jurisdiction, subject to any non-waivable consumer rights and mandatory protections available in your jurisdiction.
